1. Introduction
1.1 Welcome to Service Spote, an online platform owned and operated by Wooing Inspiration Technologies Private Limited ("Company"). Service Spote ("Platform") is designed to connect service providers ("Businesses") with customers ("Customers") seeking services, offering the added benefit of discounts through coupon generation.
1.2 These Terms and Conditions ("Terms") govern your access to and use of the Platform, including any content, functionality, and services offered on or through the Platform. By accessing or using the Platform, you agree to comply with and be bound by these Terms.
1.3 If you do not agree with these Terms, you must not use the Platform. Your continued use of the Platform following any changes to these Terms constitutes acceptance of those changes.
2. Definitions
2.1 "Platform" refers to the Service Spote website and any associated mobile applications.
2.2 "Business" refers to any individual or entity that registers on the Platform to offer services and provide discounts to Customers.
2.3 "Customer" refers to any individual or entity that uses the Platform to search for Businesses and generate discount coupons.
2.4 "Coupon" refers to a discount code generated by Customers on the Platform, which can be redeemed for a discount on services provided by a Business.
3. Account Registration and Obligations
3.1 Customer Accounts
3.1.1 To access certain features of the Platform, Customers must register for an account. During registration, Customers are required to provide accurate, complete, and current information.
3.1.2 Customers are responsible for maintaining the confidentiality of their account information, including their password, and for all activities that occur under their account.
3.1.3 Customers agree to immediately notify the Platform of any unauthorised use of their account or any other breach of security.
3.2 Business Accounts
3.2.1 Businesses must register for an account to list their services and offer discounts on the Platform. The information provided during registration must be accurate and up-to-date.
3.2.2 Businesses are responsible for ensuring that all details related to their services, including the discount percentages offered, are correctly listed and updated as necessary.
3.2.3 Businesses must ensure compliance with all applicable laws and regulations related to the services they offer through the Platform.
4. Use of the Platform
4.1 Platform Access and Use
4.1.1 The Platform provides a search functionality for Customers to locate Businesses offering specific services. Customers can generate Coupons for discounts provided by Businesses.
4.1.2 The Platform acts solely as an intermediary between Customers and Businesses. It does not endorse, recommend, or guarantee any Business or service listed on the Platform.
4.1.3 The Platform is not responsible for the accuracy, reliability, or completeness of any information provided by Businesses, nor does it guarantee that the discounts offered by Businesses will be honoured.
4.2 Prohibited Uses
4.2.1 Users are prohibited from using the Platform for any unlawful or fraudulent purposes.
4.2.2 Users must not engage in any activity that could damage, disable, overburden, or impair the functioning of the Platform or interfere with any other party's use of the Platform.
4.2.3 Unauthorised use of any content or information on the Platform, including the reproduction, modification, or distribution of such content, is strictly prohibited.
5. Business Listing and Subscription Plans
5.1 Listing Charges
5.1.1 Listing a Business on the Platform is a chargeable service. Businesses must choose from various subscription plans offered by the Platform, each with different levels of visibility and features.
5.1.2 The subscription plans are not free for lifetime listing. Businesses are required to renew their subscription according to the terms of the selected plan to maintain their listing on the Platform.
5.2 Subscription Renewal and Unlisting
5.2.1 Businesses will receive notifications regarding the expiration of their subscription plan. It is the responsibility of the Business to renew their subscription in a timely manner.
5.2.2 If a Business fails to renew its subscription, the Platform reserves the right to unlist the Business from the Platform. Unlisted Businesses will no longer be visible to Customers and will not appear in search results.
5.2.3 The Platform may offer grace periods for renewal at its discretion, but this is not guaranteed. Businesses are encouraged to renew well before the expiration date to avoid any disruption in their listing.
6. Coupon Generation and Redemption
6.1 Coupon Generation
6.1.1 Customers may generate Coupons through the Platform for discounts on services provided by listed Businesses. The discount percentage and terms of use are determined by the Business offering the service.
6.1.2 Once a Coupon is generated, it is non-transferable and cannot be exchanged for cash or any other form of compensation.
6.2 Coupon Redemption
6.2.1 Customers are responsible for presenting the Coupon to the Business at the time of service. The terms of the discount are as specified by the Business at the time the Coupon was generated.
6.2.2 The Platform is not liable if a Business refuses to honour a Coupon. Customers are advised to confirm the validity of the discount with the Business before availing of the service.
6.2.3 Coupons are subject to the expiration date and any other conditions specified by the Business.
7. Public Listing of Business Information
7.1 By registering on the Platform, Businesses consent to the public listing of their information, including but not limited to their business name, contact details (phone number, WhatsApp number, email address), physical address, social media links, and website.
7.2 The Platform reserves the right to remove or modify the listing of any Business at its discretion, without prior notice.
8. Privacy and Data Protection
8.1 The Platform is committed to protecting the privacy of its users. Personal information collected from Customers and Businesses is handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference.
8.2 By using the Platform, Customers and Businesses consent to the collection, use, and disclosure of their personal information as described in the Privacy Policy.
9. Dispute Resolution
9.1 The Platform is not a party to any agreement between Customers and Businesses and is not responsible for resolving disputes that may arise between them.
9.2 Customers and Businesses agree to first attempt to resolve any disputes through direct negotiation.
9.3 If a dispute cannot be resolved through negotiation, the parties may seek resolution through mediation or arbitration, as mutually agreed upon.
10. Limitation of Liability
10.1 The Platform, its owners, directors, employees, and agents shall not be held liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the Platform.
10.2 The Platform is provided on an "as is" and "as available" basis. The Company makes no warranties or representations, express or implied, regarding the operation or availability of the Platform, the accuracy of the information provided by Businesses, or the reliability of the services offered.
10.3 The Company does not guarantee that the Platform will be free from errors, viruses, or other harmful components. Users are responsible for implementing safeguards to protect their devices.
11. Intellectual Property
11.1 All content on the Platform, including text, graphics, logos, icons, images, audio clips, and software, is the property of the Company or its content suppliers and is protected by applicable copyright, trademark, and other intellectual property laws.
11.2 Users are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes. Any other use of the content on the Platform is strictly prohibited without the prior written consent of the Company.
12. Indemnification
12.1 Users agree to indemnify, defend, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to their use of the Platform, violation of these Terms, or infringement of any intellectual property or other rights of any third party.
13. Termination
13.1 The Company reserves the right to terminate or suspend any user's access to the Platform, without notice, for conduct that the Company believes violates these Terms or is harmful to other users, the Company, or third parties, or for any other reason in its sole discretion.
13.2 Businesses may be removed from the Platform for failing to honour discounts as promised or for providing inaccurate or misleading information.
14. Changes to the Terms and Conditions
14.1 The Company reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Platform.
14.2 Users are responsible for reviewing these Terms periodically to stay informed of any changes. Continued use of the Platform after the posting of changes constitutes acceptance of those changes.
15. Severability
15.1 If any provision of these Terms is found to be invalid or unenforceable, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.
16. Entire Agreement
16.1 These Terms, together with the Privacy Policy and any other legal notices and agreements published by the Company on the Platform, constitute the entire agreement between the user and the Company concerning the use of the Platform.
